LERT:
Back in 1996, Justice Antonin Scalia penned the following words in a
scathing dissent from a case: "What secret knowledge, one must
wonder, is breathed into lawyers when they become Justices of this
[Supreme] Court, that enables them to discern that a practice which
the text of the Constitution does not clearly proscribe, and which
our people have regarded as constitutional for 200 years, is in fact
unconstitutional? . . . Day by day, case by case, [the Court] is
busy designing a Constitution for a country I do not recognize."
Justice Antonin Scalia |
A decade has passed
since Justice Scalia raised this all-too-true objection to the
Supreme Court's usurpation of the power to govern the United States.
Judicial power has become much more bloated in that decade, and
Americans are finally beginning to say "enough!"
A bill is now being circulated in the U.S. House of Representatives
that would address this HUGE issue head-on. Called the "Judicial
Conduct Act", it was written by Rep. Todd Akin (R-MO).
The Judicial Conduct Act provides certain specific definitions of
the grounds for impeachment of federal judges and of the termination
of their terms of office due to lack of "good behavior."
Specifically, this Act would designate that the entering or
enforcement of orders and decisions in contradiction of the original
understanding of the United States Constitution or, based upon
judgments, laws, agreements, or pronouncements or foreign
institutions, governments, or multilateral organizations, are
impeachable offenses.
Rep. Todd Akin (R-MO) |
Rep. Akin wants to
bring this bill up before Congress -- but he needs a LOT more
cosponsors in order to make it a viable bill. WE need to ask our
Representatives to "step up to the plate" and sign on as cosponsors,
NOW!
TAKE ACTION: Too many judges
and lawyers believe that separation of powers is a one-way street.
It's fine for a federal court to tell Congress that it's done a
lousy job drafting a statute, but when Congress dares to criticize
judges and justices for overstepping their authority, we're told the
"fabric of our republic" is suddenly at stake. This is NONSENSE. The
greater threat to our nation arises if the other two branches of
government continue to fail at holding the courts accountable to
their Constitutional mandate and its inherent restrictions.
Judges who legislate from the bench subvert our republican form of
government of the people, by the people, and for the people, and
threaten all these legislative aims. Therefore, we must URGENTLY
call for Judicial Restraint, and an end to Judicial Activism.
This is a great way to start that process. Click "Go!" NOW to
send a FREE message to your Representative, asking him or her to
contact Rep. Akin's office in order to become a cosponsor of the
"Judicial Conduct Act".
NOTE: Be sure to send this Alert to EVERYONE you know who
wants to help hold Federal judges accountable for their actions.
Thank you!
